Order of the Judge-Commissioner Regarding Changes to the Schedule for Work on Settlement Proposals

The administrator of the sanation estate of PKP CARGO S.A. under restructuring (“the Company,” “the Administrator”) announces that today, the Judge-Commissioner, following motions filed by the Administrator and the Creditor – the European Investment Bank – as reported by the Company in Current Report No. 82/2026, issued an Order regarding:

– to repeal its own resolutions dated June 30, 2026, and September 4, 2026, which the Company disclosed in Current Reports No. 61/2026 and No. 72/ 2026 regarding the deadlines for submitting Arrangement Proposals to be put to a vote, as well as the deadlines for the Creditors’ Council to issue its opinion on the Arrangement Proposals;

– the Administrator’s obligation to provide the Judge-Commissioner, by December 4, 2026, with preliminary information regarding the progress of the takeover of the day-to-day management of the company, the actions taken, and the most urgent operational and financial needs of the Company;

– a call to the Creditors’ Council, its individual members, and other interested creditors (in particular, the European Investment Bank) to submit, by December 4, 2026, a concise statement regarding the possible future course of the proceedings, the possibilities for preparing updated Composition Proposals, as well as information regarding the course of cooperation between the Company/the Administrator and the Creditors from the moment the Company’s management was taken over by the Administrator;

– a statement that further actions regarding material matters related to the schedule of the proceedings, including the schedule for voting on the arrangement, will be taken after December 4, 2026, unless the circumstances of the case change.
