Order of the Judge-Commissioner Regarding the Extension of the Deadline for Submitting the Final Text of the Settlement Proposals

The administrator of the restructuring estate of PKP CARGO S.A. under restructuring (“the Company”, “PKP CARGO”) announces that on May 8, 2026, the Judge-Commissioner issued an Order regarding the extension of the deadline for PKP CARGO to submit its Arrangement Proposals, in which:

– The Judge-Commissioner has set a new final deadline for PKP CARGO and the entities specified in Article 155(2) of the Bankruptcy Law to submit their Arrangement Proposals, which will be put to a vote in the subsequent proceedings, as of June 30, 2026 – while also indicating that in the event of issuing a decision in a subsequent step to conduct a vote without convening a creditors’ meeting (Article 110(7) of the Bankruptcy Law), he does not intend to allow any further amendments to the Arrangement Proposals after the aforementioned date or the submission of new Arrangement Proposals;
– Require the Administrator and PKP CARGO to obtain the opinion of the Creditors’ Committee before filing the final version of the Arrangement Proposals with the case file and submitting the draft of the final Arrangement Proposals to the Creditors’ Committee and its individual members, no later than May 22, 2026;
– Require PKP CARGO and the Administrator to provide explanations and to make available or provide the Creditors’ Council or its individual members with the Company’s documents to the extent that they form the basis for the drafting of the proposed Arrangement Proposals – to the extent that this does not violate trade secrets, including those of PKP CARGO.

The above Order of the Judge-Commissioner was issued following the submission of motions by the Company and the Receiver for PKP CARGO’s reorganization proceedings, as announced by the Company in Current Report No. 28/2026 on April 23, 2026.
