Order of the Judge-Commissioner on setting a deadline for the Creditors’ Council to express its opinion on the Restructuring Plan

The administrator of the rehabilitation estate of PKP CARGO S.A. under restructuring (the “Company”) hereby announces that on February 20, 2026, it was notified of the issuance by the Judge – Commissioner had issued an order requiring the Creditors’ Council to submit its position on the Company’s Restructuring Plan and any new amendments or clarifications thereto by March 17, 2026.

At the same time, the Judge-Commissioner announced in the Order that after the expiry of the above-mentioned deadline, he would consider the possible approval of the Restructuring Plan in its current form. He also pointed out that, pursuant to Article 318 of the Restructuring Law, even after approval, it may still be modified and amended, and the Creditors’ Council’s right to issue an opinion on it does not formally block the possibility of approving the document.

In the opinion of the Judge-Commissioner, the objectives of the proceedings require the approval of the Company’s Restructuring Plan without further unnecessary delay, so that both the Administrator and the Company can take appropriate legal and factual actions that are authorized and legally protected in the approved Restructuring Plan.

The above Order of the Judge-Commissioner was issued following a motion filed by the Creditors’ Council, which the Company announced in its current report No. 8/2026 on February 2, 2026.
