Order of the Judge-Commissioner granting consent to extend the deadline for the Creditors’ Council to express its opinion on the Restructuring Plan and Proposals
The administrator of the rehabilitation estate of PKP CARGO S.A. under restructuring (the “Company”) hereby announces that on December 1, 2025, it was notified that the Judge-Commissioner had issued an order granting consent and extending the deadlines for the PKP CARGO S.A. Creditors’ Council under restructuring (“Creditors’ Council”) to express its opinion on the Restructuring Plan and Arrangement Proposals, setting a new deadline for their submission on February 2, 2026.
At the same time, due to the circumstances of the case, the Judge-Commissioner obliged the Company and the Administrator to cooperate with the Creditors’ Council in matters related to the Restructuring Plan and the Arrangement Proposals, and set a deadline for the Company to submit the final text of the Arrangement Proposals, which would be put to a vote, by February 27, 2026.
In the Order, the Judge-Commissioner emphasized that the above deadlines are, as a rule, final and may only be extended to a limited extent and due to special circumstances other that those raised so far, upon a written and justified request only from the Creditors’ Council or the Administrator, while also informing that the voting procedure on the arrangement will be carried out without undue delay, immediately after obtaining the documents indicated above.
The above Order of the Judge-Commissioner was issued following a motion field by the Creditors’ Council, about which the Company informed in its current report No. 105/2025 on November 17, 2025.
