Court ruling dismissing the Administrator’s request to withdraw from the mutual agreement

The administrator of the sanation estate of PKP CARGO S.A. under restructuring (the “Issuer”, “Company”) with reference to current report No. 25/2025 of April 22, 2025, hereby announces that today it has been informed of the issuance on October 28, 2025, of a decision by the District Court for the Capital City of Warsaw in Warsaw, 18th Commercial Division, amending the decision of the Judge-Commissioner of April 19, 2025, in such a way as to dismiss the Administrator’s motion.

Pursuant to the Decision of April 19, 2025, the Judge-Commissioner consented to the withdrawal by the Administrator of the Issuer’s rehabilitation estate from the mutual agreement terminated by the Company on June 11, 2024 i.e. the Agreement on Mutual Obligations of the Parties of the Collective Bargaining Agreement for Employee Employed by PKP CARGO S.A. concluded on February 14, 2005 (the Valentine’s Day Agreement), with effect from the date of commencement of the Company’s rehabilitation proceedings, i.e. from July 25, 2024.

The Issuer is not entitled to appeal against the Decision of October 28, 2025.
